… as Nchito is ordered to explain lies

Director of Public Prosecution Mutembo Nchito has been to respond to allegations that he lied to the Parliamentary select committee when he was being screened for his current job.

The ruling has been made by the Law Association of Zambia (LAZ) has finally resolved that it will hear the complaint of alleged professional misconduct by Director of Public Prosecution (DPP) Mutembo Nchito filed before it by Solwezi Central Member of Parliament Lucky Mulusa.

The MMD Parliamentarian had complained to the association that Nchito allegedly lied to the select committee when he was being screened for his job.

Nchito, he said, had undertaken not to participate and prosecute matters involving former president Rupiah Banda who was blamed for the demise of Zambian Airways of which Nchito was a director resulting in a debt of K14 billion against the Development Bank of Zambia.

He had also assured the committee that he would not undertake nor participate in matters involving Finance Bank chairman whom he owed US$4 million through the defunct Zambian Airways

Instead Nchito entered into two nolle prosequi in criminal cases against Dr. Rajan Mahtani .

In a letter dated November 18 and addressed to both Nchito and Mulusa, LAZ secretary Silas Mambwe has advised both parties that upon deliberations, the Legal Practitioners Committee has resolved to hear the complaint after being satisfied that it had jurisdiction to do so adding that a formal ruling will be delivered in due course.

The letter further observed that Nchito did not, in his response delve into the merits of the complaint and the committee has now urged that this be done in order to afford Mulusa the right to reply where after the matter will be scheduled for hearing on a date.

Nchito had written to LAZ explaining that he was above such committees and as such could not appear before them for disciplinary charges

  1. Nchito must abide by the statutory regulations propagated by the Law Association of Zambia which granted him the Licence to practice in the Zambian (NOT Malawian) Courts of Law.

    Zambian Citizens expect all Lawyers to demonstrate the highest levels of honesty with integrity. In this regard we pray that LAZ will execute its authority to protect this honourable body.

  2. What arrogance! Thought Mutembo is able to practice because of his registration and membership with LAZ. As DPP he now feels he is above the body that enables him to practice. Mutembo should consider himself lucky that LAZ is not as vindictive as he is.
