Justice Minister Wynter Kabimba and Solicitor General Musa Mwenye must be arrested and jailed for contempt, abuse of office and abuse of authority for conniving to subvert and undermine the independence of the Judiciary by writing a letter on behalf of the Patriotic Front (PF) to Acting Chief Justice Lombe Chibesakunda outlining their legal opinion on nullification of Petauke Central, Malambo and Mulobezi parliamentary seats when the matter was already before the court of law, Douglas Siakalima has said.
Siakalima has also said Mwenye should with immediate effect resign because his position as Solicitor General had become untenable for having participated in a partisan scheme that was meant to block Dora Siliya, Maxwell Mwale and Hastings Sililo from recontesting their Petauke, Malambo and Mulobezi seats respectively.
“What Kabimba and Mwenye did is contemptuous and abuse of office and authority. They must be arrested and jailed for conniving to undermine and interfere with the independence of the Judiciary. The matter on which the two rendered their legal opinion to Acting Chief Justice was an ongoing court process. Kabimba must explain why he instructed Justice Chibesakunda to take action against Siliya, Mwale and Sililo who were aspiring candidates in their respective constituencies. They must be arrested and jailed for contempt and abuse of authority and office, Siakalima said.
Siakalima who is former Siavonga UPND Member of Parliament said the Supreme Court ruling on contempt charges against MMD president Nevers Mumba had exposed Mwenye as a PF cadre who was using public resources to conduct political activities for the ruling party.
He told the Daily Nation yesterday that what Kabimba as PF secretary general and Mwenye as Solicitor General did was contemptuous because the duo’s intention was to influence the decision of the Supreme Court to block Siliya, Mwale and Sililo from participating in the by-elections in their constituencies.
Siakalima said that the Supreme Court was candid in stating that the letter Kabimba wrote to the Acting Chief Justice had created a perception that the ruling party was exerting pressure on the Judiciary.
The UPND official said Kabimba and Mwenye had been discredited by the Supreme Court and had therefore lost the legitimacy of holding public offices.
He stated it was good that the MMD leader complained about the way the Supreme Court was indiscriminately nullifying seats for the opposition political parties because that had given the highest court in the land an opportunity to cleanse itself of the perception that it had been corrupted and compromised by the PF.
He said the Supreme Court had done well to expose the letter and the schemes orchestrated by Kabimba and Mwenye adding that had Dr Mumba not made the contemptuous remarks against the court, Zambians would never have known the pressure that was being exerted on the Judiciary.
