MMD NEC ember counsels Raphael Nakachinda, Nevers

AN MMD national executive committee member has advised party spokesperson Raphael Nakachinda not threaten and accuse the Daily Nation for reporting the demands and concerns of MMD members nation-wide because it is the duty of the newspaper to inform, educate and entertain.

Mr Tryson Simukoko said Mr Nakachinda should not mislead members that party president Nevers Mumba’s term ends in 2017 because Dr Mumba was democratically elected to finish Rupiah Banda’s term which expires in April 2016. Mr Simukoko said in a statement to the Daily Nation yesterday that Dr Mumba ascended to the party’s presidency through casual vacancy and will therefore be subjected to election during the coming convention.

“MMD has no constitutional provision to run two parallel terms of five years each, one for ordinary members and another for the president. Article 18 (5) of the party constitution states that casual vacancies other than that of the president in between convention be filled by the NEC by a secret ballot until the following election.

“Dr Mumba ascended to the party’s presidency through casual vacancy and will therefore be subjected to election during the coming convention.

‘‘There is no clause in our constitution stipulating that the party will hold a separate convention to elect the president after a constitutional term officially ends,” Mr Simukoko said.

Mr Simukoko said Mr Nakachinda should be reminded that those who were demanding that the convention be held next April were genuine founders and bonafide members of the party unlike him who never went through the ranks of the party.

“He should stop labelling them as masquaraders, but real members advocating for the adherence to the party constitution as platform for maintenance of discipline.

‘‘There is no morality in talking about reconciliation and at the same time perceive them that they are not members of the same party,” he said.

He also said there was no exhibition of morality when Dr Mumba went to Lufwanyama constituency ‘‘without the courtesy’’ of informing the MMD Member of Parliament for the area and instead accused her of belonging to another party.

“Recently, Hon Mutati told the nation that all those MPs who supported UPND in the January 20 elections are MMD members and there are no reasons to doubt the fact.

‘‘So when Dr Mumba went to Lufwanyama constituency and started to accuse the area MP of belonging to another party, he was creating factionalism between the officials supporting the MP and those who might not.

“That was a visitation of article 10(h) which states that a member of the party has an obligation to oppose factionalism and defend the party. What morality is that?

‘‘When Nevers Mumba and his group were on the Copperbelt they spent a whopping K150million (150 billion in old currency) in less than  two weeks, enough to conduct several conventions and effectively mobilize and organize the party,” he said.
